The basic terms that apply to your use of the Finch website, desktop app, downloads, and related services

Welcome to Finch. These Terms of Service apply to the Finch desktop app, the official Finch website, release downloads, and related services provided by Finch.

By downloading, installing, accessing, or using Finch, you acknowledge that you have read and agree to these Terms. If you do not agree, please stop using the relevant services. Third-party models, tools, mini tools, and services you connect may have additional terms, which you must also follow.

1. Finch Services

Finch is a local-first agent application that helps people complete creative, research, organization, and development tasks through natural language, models, files, Skills, tools, and mini tools.

Available features may vary by platform, version, region, or configuration. Some capabilities rely on the internet, third-party models, APIs, OAuth, MCP services, or other external infrastructure, and may incur fees charged by third parties.

We may add, modify, suspend, or remove features as we continue to improve experience, security, and maintainability. The official website and official release channels are the authoritative source for release information.

2. Eligibility and Account Security

You must have the legal capacity required to accept these Terms. Minors should use Finch with the consent and guidance of a parent or guardian.

If you connect Finch using a third-party account, subscription, API key, or access token, you are responsible for ensuring that you have the right to use those credentials and for keeping your device and accounts secure. You are responsible for risks arising from the sharing, disclosure, or improper storage of credentials.

3. License and Intellectual Property

The Finch software, website, brand, design, documentation, and related content are protected by applicable intellectual property laws. Except as expressly permitted by an open-source license or separate written authorization, we reserve all rights.

Where any Finch code or component is made available as open source, you may use that portion under the license in its corresponding repository. Third-party libraries, models, materials, and services are governed by their own licenses and terms.

These Terms do not grant you any rights to Finch trademarks, brand assets, or intellectual property not expressly authorized. You may not use the Finch name or marks in a manner that suggests official endorsement, partnership, or a source relationship without permission.

4. Your Content and Task Outputs

You retain the rights you hold in the text, files, prompts, code, and other content you submit to Finch. You must ensure that you have the right to process that content and are responsible for its legality, accuracy, and backup.

To carry out a task you initiate, you authorize Finch to read, transform, transmit, or store the relevant content to the extent necessary. The specific processing depends on the models, tools, mini tools, permissions, and third-party services you choose.

AI-generated content may be inaccurate, incomplete, out of date, or similar to other content. You must review it before using, publishing, or relying on it, particularly for code execution, financial, legal, medical, safety, privacy, or other high-risk matters.

5. Mini Tools, Skills, and Third-Party Services

Finch supports installing Skills and mini tools and connecting to third-party services. They may be provided by the community or other third parties, and may access files, the network, Shell, keys, accounts, or other system resources.

Before installing or enabling them, you should review their source, code, documentation, permissions, and privacy policies. Unless expressly identified as officially provided by Finch, third-party content does not represent Finch's endorsement or warranty. Fees, data processing, service quality, and disputes between you and a third party are governed by that third party's terms.

6. Acceptable Use

You may not use Finch to:

  • violate applicable law, regulation, court order, or another person's lawful rights;
  • access, scan, interfere with, or disrupt devices, accounts, networks, or services without authorization;
  • distribute malware, steal credentials, evade security measures, or commit fraud;
  • infringe privacy, intellectual property, trade secrets, or other rights;
  • generate, distribute, or automatically carry out clearly unlawful or harmful content or conduct;
  • impersonate another person or falsely represent an authorized, partner, or official relationship with Finch; or
  • unreasonably consume, attack, or circumvent limits on the Finch website or related infrastructure.

You are responsible for actions performed through your device, accounts, credentials, and configuration.

7. Updates, Pre-release Features, and Availability

Finch may offer automatic updates, pre-release versions, experimental features, or test features. These may be unstable, change, or be discontinued, and should not be used for critical tasks without validation and backups.

We work to keep services available and software secure, but do not guarantee that any feature will always be available, entirely error-free, or compatible with every environment. Maintenance, network failures, third-party service changes, security incidents, or events beyond our reasonable control may cause interruptions.

8. Disclaimers

To the maximum extent permitted by applicable law, Finch is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or the accuracy of results.

Finch is not a substitute for professional judgment. You should independently evaluate model outputs, tool calls, code changes, file operations, and automated tasks, and maintain reliable backups of important data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Finch and its maintainers will not be liable for any indirect, incidental, special, punitive, or consequential losses arising from the use of, or inability to use, Finch, third-party services, user content, or generated outputs, including loss of data, profits, business interruption, or goodwill.

Where applicable law does not permit the exclusion or limitation of certain liability, the relevant limitation applies only to the extent permitted by law.

10. Termination

You may stop using Finch at any time. If you materially breach these Terms, endanger user or system security, or expose us to legal risk, we may limit your access to online services operated by Finch to a reasonable extent.

After you stop using Finch or your access is terminated, provisions that by their nature should survive will remain in effect, including those relating to intellectual property, disclaimers, limitations of liability, and dispute resolution. You are responsible for retaining or deleting local data on your device.

11. Changes to These Terms

We may update these Terms to reflect changes in our product, technology, law, or operations. The updated version will be posted on this page with a revised date. Where appropriate, we will provide notice of material changes through the website, the app, or another suitable method.

Your continued use of Finch means that you accept the updated Terms. If you do not agree, you should stop using the relevant services.
